Domain name buy, but still taken?

Interested in a domain name .com
on the info of “who is” appears that:
Expires on: 03-Jul-08
Today Is: 04-Jul-08
So it has expired right?
Yes it has expired and the “owner” has not payed the renew
but…………….. still appears that is already taken
how much do I have to wait so I can grab it?
I mean that appears aviable?
The thing here is that was mine! but hijacked, On December 14 2007.
That day I entered mi site and appeared a Croatia flag along with a skull
I checked with my registrar and the hackers entered via my domain registrar! BTW It was godaddy
I wrote them but they didnt believed me, so, I ended witha hacked site and a hacked registrar acces, so these Croatia hackers changed the contact info to nosnese characters:

So I wanted to wait until July 3 2008 to re-purchase my domain.

    You have to wait exactly 75 days since the “Expires On:” date in order to buy a domain name that expired. It takes this long to get out of the ICANN database and make absolutely sure the original owner doesn’t want to renew. He has that entire 75 days to renew, but after the “Expires On:” date, the fees start getting pretty hefty.
