So in all the confusion of learning to build my own site along with familiy siutations and full time work problems I failed to remember to renew my Domain Name!

Top it off it’s already taken by a domain selling company! Now my problem isn’t so much the domain name I can change it to something else I didn’t really get enough traffic for that to be an issue.

My problem is my Brand Name is Notorious Apparel and with that being the domain name as well, this resale company has text to insinuate that they are Notorious Apparel. I understand the content is necessary for search engines. But it definitley causes issues with my brand. I plan to email them and ask them to change their content so that it doesn’t cause a confliction, but before i do I was hoping somone would know how much of my brand name i actually own?

I am a sole Proprietor with other than uploading images my brand logo and the T-shirts I create onto CafePress and other print on demand sites, as well as facebook, myspace, twitter, etc. do I have any rights at all?

I don’t own the trademark but I have been establishing this brand since 2006.

I’ve heard something about common-law trademark but haven’t checked it out yet
