You are correct that a domain name can't be transferred to another registrar while it's locked. But if the domain name's not yours, then do what some of the others answered like trying to "buy" it from its current registered name holder or look for another name.

Unless you can demonstrate trademark rights to the term that's matching or similar to the domain name and how the name's being used is possibly infringing your trademark, no one has any demonstrable rights to the domain name in question. Then again, life is too short spending possibly too much time and effort trying to get something that doesn't belong to you.

what makes you think that when feb 2007 rolls around that it becomes free to get? You do know that domain names can be renewed long before it expires.

The only way to get a domain name that is already taken is to offer the person who owns it money to buy it out from them. Otherwise, you have to wait till it becomes available again either by neglect of the owner (forgets to renew) or he abandons it.

There's a good reason companies make you pay more for a locked domain - so someone can't claim to be them and steal it.

Just wait it out, or offer the owner of the domain a purchase / transfer price.
